TRO sa Internal Rules sa Sangunian ipatuman-VM Bañas

Sanguniang Panglunsod- Ipatuman sa sulod sa 20 ka adlaw ang (TRO) Temporary Restraining Order nga giluwatan ni Hon. Judge Panambulan M. Mimbisa sa RTC Branch 37 sa milabay nga semana.

Matud pa ni Vice Mayor Shirlyn Bañas Nograles nga gihatagan ug lugway nga 20 ka adlaw ang na-expire  nga “72-oras” nga tagal nga gihatag ang korte kaniadtong milabay nga Abril 18 may kalabutan sa ilang kaso nga gipasang-at nilang Hon. City Coun. Ronnel Rivera ug Hon. Dominador “Dom-Dom” Lagare III batok nilang Kag.Beth Bagonoc, Kag. Vivencio Dinopol,Kag.Richard Atendido,Kag.Nepthalie  Natividad,Kag. Eduardo Leyson IV, Kag.Dante Vicente, Kag.Virgie Llido, Kag. Jan-jan Oco, Kag.Margareth Santos, Kag.Remus DeClaro ug Brgy.Capt.Lourdes Casabuena may kabahin sa ilang Internal Rules and Procedure (IRP).

“as of this day the 72 hours TRO issued by the court on Monday 18 April has expired.While it is so pending submission of the compliance by counsels for petitioners and respondents on the prescriptions setforth under OCA Circular No. 108 and the filing of the answers of the respondents, this temporary Restraining Order is extended (20) days pursuant to Rule 58 Sec.5 of the Rules Of Court and the 72 hours gone by”. Kini ang unod sa order nga pinirmahan ni Hon Judge Mimbisa sa Civil Case No. 8045 nga pinitsahang kaniadtong Abril 25 tuig kasamtangan.

Matud pa ni VM Bañas nga dunay pipila  sa mga nakalatid nga probisyon sa ilang 16th IRP sa Sanguniang Panglunsod  ang napailawom sa TRO ug kini naglangkub sa “Declaration Of Nullity Of Rule IV Sec.3(f),Rule IV Sec.I(k),Rule IV Sec.12,Rule IV Sec.5(d),Rule VI Sec.4,Rule VI Sec.6,Rule X Sec.7,RuleXI Sec.3 of the IRP NO.4 Series of 2010 sa SP,General Santos City.

Samtang nga gikanayun usab ni Atty. Fransisco”Bong” Gacal ang abugado sa mga petitioner nga sa kasamtangan nga dunay Temporary Restraining Order mahimo na nga gamiton ang Internal Rules and Procedure sa  15th Sanguniang Panglunsod hangtud nga dunggon pa ang hearing sa “Writ Of Preliminary Injunction” karong umaabot nga Mayo 9,2011 (Anter Alcos)
